Senator Moye Condemns Monrovia City Court Subpoena Against UP’s Boakai

Bong County Senator Prince Moye has expressed dismayed and termed the Summon Duces Testificadum by the Monrovia City Court against former ruling Unity Party Stander Bearer Amb. Joseph Nyumah Boakai was complete harassment, intimidation, and a clear attempt by the (CDC) government led by President Weah to use the Court to muscle the opposition community.

According to Senator Moye, CDC is using the Court to muscle the opposition community instead of paying attention to the growing wave of hardship and poverty the country is experiencing under Mr. George Manneh Weah’s leadership.

Sen. Moye spoke via phone on the OK Morning Rush when UP Sectary General Mo Ali made his appearance Wednesday, April 20, 2022. The Bong County lawmaker pointed out that if the Government of Liberia is going to use the Court to encroach on the opposition to give the people the impression that they are weakling, depressing, and suppressing the opposition – the Government is making a big mistake.

The opposition Lawmaker lamented that when CDC was in opposition, there was time they held protests and several people lost their lives but with all that, people acted in sympathy with their party, thereby voting it to power. He added that requesting the appearance of Amb. Boakai at the Court would give Liberians the space to love him more.

“What I see happening is constant intimidation of the opposition mainly figures of Joseph Nyumah Boakai that is loved by the people. Carrying him to court is going to further project him what the Liberian people want. Amb. Boakia is going to make sure that this country is liberated, the forceful appearance of Amb. Boakai at the court is like getting him to love more by the Liberian people’’ Senator Moyee stated.

The Former Vice President Joseph N. Boakai was next in line to testify at the ongoing criminal trial of the Alternative National Congress (ANC) political leader Alexander B. Cummings and others.

Last week, Magistrate Jomah Jallah granted state lawyers’ request to have Mr. Boakai appear to testify for the State against the ANC Political Leader, its National Chairman Daniel Naateeh, and Secretary-General, Counselor Aloysius Toe. Magistrate Jomah Jallah of the Monrovia City Court cited Mr. Boakai to appear on April 19, 2022, to testify as to the second witness for the state, as requested by state prosecutors.

The news come as defense Lawyers rested with cross-examination of state witness Theodore Momo, noting that his responses indicated no alterations of the Collaborating Political Parties (CPP) framework document as reviewed and submitted by the CPP team of Lawyers.

But on Tuesday, April 19, 2022, Mr. Boakia failed to honor the court request on grounds that he did not receive any communication from the court citing him as a witness to testify against Mr. Cummings in the ongoing criminal trial.

The Sheriff’s returns showed that the writ of Subpoena Duces Tecum and Subpoena Ad testificandum were first taken to the Unity Party(UP) headquarters on Broad Street in Monrovia, but the former Vice President wasn’t seen to serve him the writ on April 15, 2022.

On the 16th day of April A.D. 2022, the sheriff said he again took the writ mentioned above to the home of the former Vice President at Rehab in the Paynesville suburb of Monrovia, where the sheriff was received by EPS personnel and he was told that the former Vice President was getting dress and told to wait on him, something the Sheriff did.

But court record shows that after a while, his EPS bodyguards came back and informed the sheriff that the former Vice President had gone to the Monrovia suburb of Gardnerville after he was told that the former Vice President was getting dressed and he should wait a while.

However, when the writ was announced at the court, media reports, that Amb. Boakai is preventing the court officers from serving a Writ of Subpoena Duces Testificadum on him. The reports claimed over the weekend that the Former Vice President made himself impossible to be reached with instructions to his securities not to allow the sheriff to enter his Rehab residence. This is after the Solicitor-General publicly announced that Boakai will appear in court on Tuesday, April 19, as the “Star Witness of the government”.
