Monrovia, Liberia—Dr. Isaac P. Podah, president of Lofa County University; B.S. Catakwa, VPA; Anthony C. Crayton; and Varmuyan L. Kanneh, all of the City of Vonjama, Lofa, filed a petition to dismiss the appeal, which the Supreme Court of the Republic of Liberia denied and dismissed. In the motion, the movants claimed that even though the respondent announced an appeal, filed its bill of exceptions, and noted exceptions to the trial court’s decision within the legally mandated time frame, the respondent neglected to fulfill other requirements that were required to perfect the appeal.
The motion specifically claimed that the respondent had failed to serve and submit its notice of completion of appeal in accordance with the legal appeal processes, as well as to file and serve its appeal bond. The Civil Procedure Law Revised Code’s Section 51.4, which states that the following actions are required to finish an appeal, was cited by the movant as grounds for the motion.
Announcement of the appeal’s taking, filing of the bill of exceptions, filing of an appeal bond, and serving and filing of the appeal’s completion notification. The Court denied the move to dismiss the appeal after considering the arguments put forth.
“WHEREFORE, AND IN VIEW OF THE FOREGOING, the motion to dismiss the respondent’s appeal is denied and dismissed, and the appeal is ordered to proceed on its merits. AND IT IS HEREBY SO ORDERED,” the Court stated in its ruling. The appeal’s merits will now be decided.
